Delay in FIR

Penal code 1860. S 302 & 324. DELAY OF 3hours and thirty minutes in lodging FIR.... CONSEQUENCES.  Accused was charged for committing murder of the brother of the complainant and causing fire arm injuries to his wife by firing .... Record showed that the occurrence occurred at 3-30a.m and The distance between the place of occurrence and police station was 5/6kilometer Complaint took three hours and thirty minutes to report the incident to police....In the prosecution evidence , there was a severe flaw to precisely fix the time when the incident was reported to police.. Inordinate delay of 3 Hours and 30 minutes remained unexplained and rendered whole of the story doubtful.... Appeal against conviction allowed....
