While the terms agent and representative are often used interchangeably in casual conversation, they have distinct legal and functional differences regarding how much power they have to act on your behalf.


1. Agent

An agent is someone authorized to act on behalf of another person (the principal) to create legal relationships with third parties.

  • Authority: They have the power to make decisions, sign contracts, and legally bind the principal.

  • Responsibility: The principal is legally responsible for the actions taken by the agent within their scope of authority.

  • Example: A real estate agent who has the power to finalize a sale or a talent agent who signs a contract for an actor.


2. Representative

A representative is a broader term for someone who stands in the place of another to present their interests or speak for them, but they don't always have the power to sign legal deals.

  • Authority: Their role is often limited to communication, negotiation, or "representing" a brand/image. They usually need to go back to the person they represent for a final decision.

  • Responsibility: They act as a face or a voice.

  • Example: A customer service representative or a member of Parliament. They speak for a group or company but cannot personally bind the entire company to a new legal debt without specific permission.

Difference in Urdu (اردو میں فرق)

اردو میں ان دونوں کے درمیان فرق درج ذیل ہے:

ایجنٹ (Agent)

ایجنٹ وہ شخص ہوتا ہے جسے قانونی طور پر یہ اختیار حاصل ہوتا ہے کہ وہ اپنے مالک (Principal) کی جگہ فیصلے کر سکے اور معاہدوں (Contracts) پر دستخط کر سکے۔ ایجنٹ کا کیا گیا کوئی بھی قانونی کام ایسا ہی سمجھا جاتا ہے جیسے اس کے مالک نے خود کیا ہو۔

نمائندہ (Representative)

نمائندہ وہ شخص ہوتا ہے جو کسی دوسرے کی جگہ صرف موجودگی ظاہر کرتا ہے یا اس کا موقف پیش کرتا ہے۔ وہ صرف معلومات فراہم کرنے یا بات چیت کرنے کے لیے ہوتا ہے، لیکن ضروری نہیں کہ اس کے پاس سودا فائنل کرنے یا قانونی طور پر مالک کو پابند کرنے کا اختیار ہو۔

خلاصہ: ایجنٹ کے پاس قانونی اختیارات زیادہ ہوتے ہیں، جبکہ نمائندہ صرف ترجمانی یا نمائندگی کرتا ہے۔
